Several folks have noted a Preliminary Concept Plan of Stolte Ranch NE of Unit 5 toward Talley Rd, and that Plan shows two lots on Crescent Hill within Rolling Oaks being developed with multiple (9) houses and a thru street (1118 Crescent Hill), and a Community Center for that development with access from Crescent Hill (1102 Crescent Hill). We've contacted the developer to advise that any such use of those lots would be a clear and open violation of the single-family residential restriction established in our subdivision's recorded Covenants and Deed Restrictions. We're advised the the subject plan is preliminary, and no formal plans have been made. The ROACC will continue to monitor this development plan, and take additional actions if needed to ensure compliance with our legally binding Deed Restrictions.

Forestar (USA) Real Estate Group, Inc. recently acquired a portion of the undeveloped land between Rolling Oaks Estates and Talley Rd., and plans to build a residential development (Stolte Ranch) there. They also acquired 2 lots on Crescent Hill Dr in Rolling Oaks with that purchase, and plan to install a through-street and 9 houses on Lot 179 and a Community Center for Stolte Ranch on Lot 175, in clear violation of the Rolling Oaks Estates Covenants and Deed Restrictions, as shown on the attached Preliminary Development Plan. Neither the ROACC nor any individual property owner is authorized to waive or alter any of the deed restrictions, as they are a legally binding contract between all property owners established to preserve and protect the character and property values of our community, and no property owner may opt out of any of the deed restrictions. The ROACC contacted Forestar in June to express our opposition to any such illegal property use, with no response to-date. We are therefore proceeding with preparations for legal action against Forestar to prevent any such uses by seeking an injunction from the Bexar County Court.
You are on this email because you have either contributed to our annual funding appeal within the past few years, or because we hope you will now support our funding need here. About 70 or the 360 Rolling Oaks property owners (about 20%) normally offer financial support. If we can gain support from 100 property owners here then we can achieve our legal defense fund goal of $25,000 with an average contribution of $250. Some can offer more, some less, but the important objective is to share this burden among as many Rolling Oaks residents as possible so that the cost does not need to be borne by just a few. Please consider the very negative impact any such property uses would have on each of our property values and the character of our community when deciding your participation amount. Also please consider the very dangerous precedence any such property uses would present toward our future defense of the deed restrictions.
We will administer and account for these funds as a separate ‘ROACC Legal Defense Fund’, and we’re asking the court to recover our legal costs against Forestar if we prevail. All moneys recovered or otherwise remaining at the conclusion of this legal matter will be refunded to each financial supporter in proportion to the donation amount (i.e. if one individual contributed 10% of the fund, they will receive 10% of the remaining money).
If you feel you can support our very critical legal defense fund, please make your check payable to ‘ROACC’ and note ‘Legal Defense Fund’ on the check. Please include your name and return address on the envelope or check so that we can properly track all donations. Contributions can be mailed to:
